1. Acceptance of Terms

By ordering, activating, renewing, accessing or using any service provided by Crystalweb LLC, the customer confirms that they have read, understood and accepted these Terms of Service.

If you do not agree with these terms, you must not use the services. These terms apply to all hosting, streaming, Web TV, Web Radio, dedicated server, technical support, customer account and related services provided by Crystalweb LLC.

Lawful useServices may be used only for lawful purposes.
No refund on abuseViolations or illegal content may result in immediate termination without refund.
BillingInvoices are issued before the service activation date and must be paid on time.
BackupsThe customer remains responsible for maintaining backups of their data.

2. Lawful Use and Compliance

Crystalweb LLC services are provided strictly for lawful use. Customers may not transmit, store, display, distribute or link to content, information or materials that violate United States federal law, state regulations, local ordinances or any other applicable legal framework.

Content that is threatening, abusive, defamatory, harassing, obscene, misleading, illegal, or protected by trade secrets, intellectual property rights or similar legal protections without authorization is also prohibited.

The customer agrees to indemnify and hold harmless Crystalweb LLC from any claims, damages, costs, penalties, liabilities or expenses arising from misuse of the services, including harm to the customer, third parties or Crystalweb LLC infrastructure.

3. Prohibited Activities and Content

Hosting, transmitting, storing, promoting or linking to material that includes, encourages or facilitates illegal activity is strictly prohibited. This applies to direct content as well as links, redirects, mirror pages, file indexes or embedded material.

  • Unauthorized, pirated or cracked software, warez, license keys, serials, cracks or bypass tools.
  • Hacking tools, exploit archives, malware, botnets, credential stealers, phishing pages, loaders, ransomware or similar malicious material.
  • Hate speech, harassment, threats, targeting of individuals or groups, violent or intimidating content.
  • Child sexual abuse material, any related illegal material and animal abuse material.
  • Content that infringes copyrights, trademarks, broadcasting rights, streaming licenses or third-party rights.
  • Spam, unsolicited bulk email, email bombing, open mail relays, blackhat SEO, deceptive redirects or mass messaging without consent.
  • Content that harms, degrades or places Crystalweb LLC, other servers, networks or internet users at risk.
Important notice: Crystalweb LLC reserves the right to immediately suspend or permanently terminate any account, without prior notice and without refund of prepaid fees, if illegal or prohibited content or links to such content are found.

4. Server Abuse, Network Security and Resource Use

Any attempt to disrupt, overload, damage, compromise, access without authorization or alter Crystalweb LLC servers, networks, services or systems is strictly prohibited.

Prohibited practices include DDoS/DoS attacks, unauthorized port scanning, brute force attacks, spoofing, abuse proxies, unapproved cryptomining, resource exhaustion, bypassing package limits, using services as command-and-control infrastructure or any action that negatively affects other customers or network stability.

Crystalweb LLC may take immediate technical measures such as rate limiting, null-routing, suspension, service isolation or termination when required to protect its infrastructure, customers and third-party networks.

5. Account, Credentials and Content Responsibility

The account holder is solely responsible for all activity carried out through their account, services, panels, servers, scripts, users and credentials.

The customer must maintain secure passwords, updated software, secure applications, recent backups and accurate contact details in the billing area. A compromised account or third-party use does not release the customer from responsibility for use of the services.

Crystalweb LLC may request immediate correction of vulnerable applications, malware infections, abused scripts or misconfigurations. In high-risk cases, the service may be temporarily suspended until the issue is resolved.

6. Billing, Invoicing and Payments

On each monthly account activation date, Crystalweb LLC issues an invoice for current service fees. Invoices are sent electronically or, where agreed, by postal mail.

Invoices are sent five days before the activation date and must be paid within ten days of receipt unless otherwise agreed in writing. Late or non-payment may result in automated reminders, suspension, limitation or termination of services.

The customer is responsible for maintaining up-to-date payment details, an active contact email and an available payment method before the due date to avoid service interruption.

Payments may be made through supported payment methods, including PayPal and major credit/debit cards processed via Stripe, as available in the billing portal.

7. Refund Policy

Crystalweb LLC may offer trial accounts or evaluation options for certain services. For this reason, refunds or partial refunds are not provided after a service is activated, as customers have the opportunity to evaluate services before making long-term commitments.

For prepaid services longer than one month, refunds are not issued for unused time because the pricing reflects a discount or commitment for long-term use. Cancellation during 3, 6 or 12 month contract periods does not create a right to a refund for remaining months.

Cases where refunds or credits are not provided

  • Geolocation, server country, routing or physical location assumptions where written clarification was not requested before purchase.
  • Failure to ask about or confirm features, limits, configuration, control panel, codec, bitrate, software or technical capabilities before ordering.
  • Suspension or termination due to violation of these Terms, illegal activity, abuse, malware, spam, phishing or prohibited content.
  • Suspension or termination due to late payment or non-payment.

8. Backups, Data and Self-Managed Services

Many Crystalweb LLC services are self-managed or semi-managed. Customers are fully responsible for maintaining independent backups of websites, databases, emails, media files, configuration files and any other data stored or processed through the services.

Any backup systems provided by Crystalweb LLC are offered as an additional operational feature and do not replace the customer's own backup responsibility. Crystalweb LLC does not guarantee that any backup will always be available, complete or restorable in every case.

9. Limitation of Liability

Crystalweb LLC is not liable for downtime, network failures, hardware failures, data loss, software errors, configuration mistakes, third-party provider failures, loss of revenue, loss of anticipated profits or indirect/consequential damages.

Services are provided on a best-effort infrastructure basis, subject to maintenance, upgrades, abuse mitigation, security events and external network conditions.

Crystalweb LLC does not guarantee a specific uptime percentage unless a separate written Service Level Agreement (SLA) has been signed with the customer.

10. Reporting Violations

Suspected violations of these Terms, abuse of Crystalweb LLC services, malware, phishing, spam, copyright/security complaints or illegal use should be reported promptly to:

Reports will be investigated. Violations may result in immediate suspension, limitation or termination of accounts and services.

11. Changes to These Terms

Crystalweb LLC may update these Terms of Service to reflect legal, technical, operational or service changes. Continued use of the services after changes are published constitutes acceptance of the updated terms.

12. Cancellation & Auto-Renewal

Services renew automatically at the end of each billing period unless the customer submits a cancellation request through the Crystalweb billing portal before the renewal date.

Cancellations take effect at the end of the current billing period. Crystalweb LLC does not provide refunds or credits for unused time on cancelled prepaid or contract services, except as expressly stated elsewhere in these Terms.

It is the customer›™s responsibility to keep a current backup of all data before cancellation. Crystalweb LLC may permanently delete all content, configurations and data associated with the service after cancellation.

13. Copyright Infringement (DMCA)

Crystalweb LLC respects intellectual property rights and responds to valid notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

To report suspected copyright infringement, send a written notice to [email protected] that includes: identification of the copyrighted work, the allegedly infringing material and its URL, your contact information, a statement of good faith belief that the use is not authorized, and a statement under penalty of perjury that the information in the notice is accurate.

Crystalweb LLC may remove or disable access to allegedly infringing material and may terminate repeat infringers in appropriate circumstances.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law principles.

The parties agree that any dispute arising out of or relating to these Terms or the services shall be subject to the exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico.
